The Licensing Officer presented a report, a copy of which had been circulated to each Member and a copy of which appears as Appendix 'A' to these Minutes in the Minute Book.
Mr Ian Crockard of Innpacked Limited, made an application on behalf of Premier Bar and Catering Limited for a new premises licence at Bournemouth Electric Club, Broadway Lane.
Councillors were asked to consider the application for Live Music, Monday to Sunday 12:00 to 23:00 hours; Recorded Music and Supply of Alcohol on and off the premises, Monday to Sunday 12:00 to 01:00 hours; and the provision of Late Night Refreshments Monday to Sunday 23:00 to 01:00.
The applicant’s agent, Mr Crockard addressed the Sub-Committee.
Councillors Borthwick and Northover addressed the Sub-Committee, on behalf of two residents, who lived near to the site, who had concerns regarding the application.
Mr Shopland, a local resident addressed the Sub-Committee, who had concerns regarding the application.
The Sub-Committee asked various questions of all parties present at the Hearing. All parties were given the opportunity to ask questions of one another. All parties were then able to sum up before the Sub-Committee retired to make its decision.
Right of Appeal
The Legal Advisor reported that all parties to the application have the right to Appeal to the Magistrates Court within the period of 21 days beginning with the day on which the Applicant is notified by the Licensing Authority of this decision in writing.
It was RESOLVED to grant the application for a premises licence for Bournemouth Electric Club, Broadway Lane, Bournemouth, with the following amendments:
a) that from Sunday to Thursday, the playing of recorded music and the supply of alcohol be permitted 12:00 to midnight
b) that from Sunday to Thursday, late night refreshment be permitted 23:00 to midnight
In addition, the conditions as set out in section M of the operating schedule of the application and the conditions agreed with Environmental Health Pollution Control and Dorset Police as set out in appendix 4 of the report pack, be added to the licence.
The Sub - Committee felt it was now appropriate that the Club Committee rescind the club premises certificate in light of the granting of the new premises licence.
Reasons for the decision:
The Sub-Committee acknowledged the problems set out in representations made by local residents and ward Councillors representing residents and believe the newly granted premises licence will give the licensing authority, Dorset Police and other responsible authorities more effective and greater control in dealing with issues that may arise, than the current club premises certificate.
