Election of Chairman to the Appeals Committee

Councillors are asked to elect the Chairman of the Appeals Committee.

Minutes:

RESOLVED:

 

That Councillor Paul Hilliard be elected Chairman of the Appeals Committee for the 2019/2020 Municipal Year.

6.

Election of Vice-Chair to the Appeals Committee

Councillors are asked to elect the Vice-Chairman of the Appeals Committee.

That Councillor Marion Le Poidevin be elected Vice-Chair of the Appeals Committee for the 2019/20 Municipal Year.

Apologies

To receive any apologies for absence from Councillors.

There were no apologies for absence received from Councillors for this meeting.

8.

Declarations of Interests

Councillors are required to comply with the requirements of the Localism Act 2011 regarding disclosable pecuniary interests. Declarations received will be reported at the meeting.

There were no declarations of pecuniary or any other interests made by Councillors at this meeting.

9.

Exclusion of the Press and Public

In relation to the items of business appearing below, the

Board is asked to consider the following resolution: -

 

‘That under Section 100(A)(4) of the Local Government Act 1972, the

public be excluded from the meeting for the following items of business

on the grounds that they involve the likely disclosure of exempt

information as defined in Paragraphs 1 and 2 in Part I of Schedule 12A

of the Act and that the public interest in withholding the information

outweighs such interest in disclosing the information.’

RESOLVED:

 

The Committee agreed to exclude the press and public for items 6, 7 and 8 of the agenda, under Section 100(A)(4) of the Local Government Act 1972 on the grounds of the likely disclosure of exempt information as defined in Paragraphs 1 and 2 in Part I of Schedule 12A of the Act and that the public interest in withholding the information outweighs such interest in disclosing the information.

School Transport Appeal

10.30am          Please refer to the non-public report circulated at ‘A’.

Minutes:

The Board considered an appeal against the refusal to provide home to school transport assistance in the form of a bus pass.

 

In considering the appeal, the Board had regard to all the supporting information provided on behalf of the appellant and by the Local Authority, including verbal submissions made by the Local Authority and appellant at the meeting.

 

RESOLVED:

 

That, having taken careful note of all the evidence presented by all parties, the appeal in respect of the appellant named in Report ‘A’ be upheld, as there were exceptional circumstances to depart from the home to school transport policy on this occasion. The assistance was granted in the form of a bus pass for the child to travel to and from school each day until the end of the 2018/19 academic year.

School Transport Appeal

Minutes:

The Committee considered an appeal against the refusal to provide home to school transport assistance.

 

In considering the appeal in the appellants absence, the Committee had regard to all the supporting information provided on behalf of the appellant and by the Local Authority, including verbal submissions made by the Local Authority at the meeting. 

 

The appellant chose not to attend the meeting.

 

RESOLVED:

 

That, having taken careful note of all the evidence presented by both parties, the appeal in respect of the appellant named in Report ‘B’ be not upheld, as there were insufficient grounds to overturn the Home to School transport policy on this occasion.

 

12.

The Committee considered an appeal against the refusal to provide home to school transport assistance.

 

In considering the appeal in the appellants absence, the Committee had regard to all the supporting information provided on behalf of the appellant and by the Local Authority, including verbal submissions made by the Local Authority at the meeting. 

 

The appellant chose not to attend the meeting.

That, having taken careful note of all the evidence presented by both parties, the appeal in respect of the appellant named in Report ‘C’ be not upheld, as there were insufficient grounds to overturn the Home to School transport policy on this occasion.
