The report relating to the schedule setting out the rates of Council Tax for 2019/20 in accordance with recommendation 4e of the report on the 2019/20 Budget and Consolidated Medium Term Financial Plan (MTFP) Update will be circulated once the precept information has been received.

The recommendations arising from the meeting of the Shadow Executive Committee held on 12 February 2019 were then considered and approved.
In accordance with The Local Authorities (Standing Orders) (England) (Amendment) Regulations 2014 a recorded vote was taken in respect of the budget items.
Dedicated Schools Grant (DSG) Funding Formulae
Councillor Mark White moved and Councillor Nicola Greene seconded that the Dedicated Schools Grant (DSG) Funding Formulae resolution as set out below be adopted:
DECISION MADE that:-
(a) the early years formula set out in Table 4 of paragraph 30 of the report be approved;
(b) the mainstream schools formula set out in Table 8 of Appendix 2 of the report for a 1.1% transfer of Schools Block funding to High Needs be approved;
(c) the final decision on the mainstream schools formula, when all DfE decisions are known, be delegated to the Bournemouth and Poole Directors of Children’s Services, in consultation with the Children’s Services Lead Members, taking into account the methodology recommended by the Shadow Schools Forum in Table 10 of Appendix 3; and
(d) the Minimum Funding Guarantee for Specialist Providers is set at minus 1.5% to allow maximum budget flexibility.

Housing Revenue Account (HRA) Budget Setting 2019/20
Councillor Karen Rampton moved and Councillor Jane Kelly seconded that the Housing Revenue Account (HRA) Budget Setting 2019/20 resolution as set out below be adopted:
DECISION MADE that:-
(a) the set of objectives proposed for the HRA operating in both Bournemouth and Poole be noted and confirmed that these are agreed for 2019/20 as follows:-
(i) deliver strong financial management of the HRA which maximises the ability to collect income, gain efficiencies and service outstanding debt;
(ii) ensure HRA stock is adequately and efficiently maintained;
(iii) focus on the delivery of strong and sustainable communities through effective housing management services;
(iv) maximise funding opportunities to deliver more affordable housing; and
(b) that it be noted that these objectives apply equally to both the Bournemouth and Poole Neighbourhood accounts and are broadly stated in order of priority. As a landlord, it is important that debt is serviced in the first instance, followed by ensuring the effective and efficient maintenance and management of the properties. Surpluses and borrowing will then be maximised to bring forward additional affordable housing;
(c) the budget for dwelling rents is reduced by 1% in line with the national July 2015 Budget statement for the coming year 2019/20 and is adjusted to reflect new rental charges for acquisitions and new builds and the impact of Right to Buy (RTB) sales. The rent policy will then change to CPI plus 1% from 2020/21 in line with changing national policy;
(d) voids continue to be budgeted at 1% of dwelling rents for both Bournemouth and Poole Neighbourhoods;
(e) the budget for garage rental charges is increased by RPI which for September 2018 was 3.3% across both the Bournemouth and Poole Neighbourhoods;
(f) the Poole Neighbourhood leasehold service charges are increased/ decreased by the following:
· 0% increase for management charges
· 10% decrease for utility costs
· 0% increase for insurance costs
(g) the Bournemouth Neighbourhood leasehold services are charged to leaseholders in line with actual costs incurred;
(h) Poole Neighbourhood tenant service charges are increased/ decreased by the following:
· 1% increase for caretaker charges
· 1.5% increase for utility charges
(i) the existing tenant service charges applied to the Bournemouth independent senior living schemes relating to laundry, scooter charging and window cleaning will be increased next financial year by 3.3% as per RPI as at September 2018;
(j) the approved Bournemouth new Tenant Service Charge Policy going live in 2018/19 will continue to be rolled out as approved with no additional increase applied for 2019/20;
(k) the PHP management fee paid from the HRA is reduced by £199k to reflect savings identified within the cost review and increased by £44k to reflect the part year impact of the Canford Heath Road development;
(l) the bad debt provision is held at 2018/19 levels for both areas - £188k for the Bournemouth Neighbourhood and £197k for the Poole Neighbourhood;
(m) the depreciation budget for the Bournemouth Neighbourhood is increased by £298k to reflect increased stock value. The depreciation budget for the Poole Neighbourhood is increased by £178k to reflect expected costs to be met in 2019/20 from the aging stock and the part year impact of Canford Heath;
(n) in order to more accurately reflect the cash flows around identified projects, funding totalling £3,647k is carried forward from the 2018/19 Poole Neighbourhood capital programme and that funding totalling £4,060k is carried forward from the 2018/19 Bournemouth Neighbourhood capital programme;
(o) to agree the proposed Poole and Bournemouth Neighbourhood maintenance programmes as set out in appendices D and J to the report;
(p) the 2019/20 Bournemouth and Poole Neighbourhoods major capital programme are agreed as set out in appendices D and K of the report;
(q) plans during 2019/20 for additional borrowing following the government’s announcements on lifting the HRA debt cap in their 2018 budget be brought forward; and
(r) the PHP delivery plan as set out in appendix M of the report be approved.

2019/20 Budget and Consolidated Medium Term Financial Plan (MTFP) Update
Councillor John Beesley moved and Councillor May Haines seconded that the 2019/20 Budget and Consolidated Medium Term Financial Plan (MTFP) Update resolution as set out below be adopted:
An amended recommendation was proposed by Councillor Paul Hilliard, this was seconded by Councillor Lesley Dedman that;
(a) A net budget of £276m, resulting in a total Council Tax Requirement of £211.1m is set for 2019/20 based on the settlement figures published by Government in January 2019. This is based upon:
i. the application of a day one Council Tax Harmonisation strategy in respect of the BCP Unitary Charge. This is determined by using the Alternative National Amount (ANA) established by the Government for 2018/19 and applying a 2.99% increase. The impact on individual tax payers can be summarised as;
1. Bournemouth’s BCP Unitary charge Council Tax being an increase of 3.5% over that levied by Bournemouth Council in 2018/19.
2. Christchurch’s BCP Unitary charge Council Tax being a reduction of 7.4% from the combined Christchurch Borough Council and Dorset County Council charge in 2018/19.
3. Poole’s BCP Unitary charge Council Tax being an increase of 6.4% over the levied by Poole Council in 2018/19.
All other recommendations remain unaltered.

DECISION MADE that:-
(a) A net budget of £274m, resulting in a total Council Tax Requirement of £209.6m, is set for 2019/20 based on the settlement figures published by Government in January 2019. This is based upon:
(i) an increase in Council Tax in 2019/20 which means that the BCP Unitary Charge will not increase above 2.99% for any residents and individual resident charges are determined in line with the approved council tax harmonisation strategy as set out in Appendix 1a and summarised as;
1. Bournemouth’s BCP Unitary charge Council Tax being an increase of 2.4% over that levied by Bournemouth Council in 2018/19.
2. Christchurch’s BCP Unitary charge Council Tax being a reduction of £8.86 from the combined Christchurch Borough Council and Dorset County Council charge in 2018/19.
3. Poole’s BCP Unitary charge Council Tax being an increase of 2.99% over that levied by Poole Council in 2018/19.
(ii) the key assumptions and provisions made in the Budget as proposed, set out in paragraph 32 (a) to (i);
(iii) the allocations to service areas in the Budget as proposed and as set out in Appendix 2a;
(iv) the use and level of all reserves to be held by the Council further to the advice of the Interim Chief Finance Officer as set out in paragraphs 83 to 94 and Appendix 3 to this report;
(v) the Capital Programme as set out in paragraphs 56 to 82 and Appendix 4;
(vi) Treasury Management Strategy and Prudential Indicators as set out in paragraphs 95 to 99 and Appendix 5;
(vii) the Chief Officers’ Pay Policy Statement for consideration and approval by the Council in accordance with the provisions of the Localism Act 2011 as set out in paragraphs 101 to 102 and Appendix 7;
(viii) that BCP Member’s Allowances for 2019/20 will be determined by the Shadow Authority after consideration of the independent remuneration panels report which is a separate item on this agenda;
(b) approve the flexible use of capital receipts strategy as set out in paragraph 75 (e);
(c) approve the BCP ICT Investment Plan as set out in paragraph 79 to be funded from the BCP 2019/20 Revenue Contribution to Capital Outlay (RCCO);
(d) approve to support the High Needs Block of the Dedicated Schools Grant for school funding a £2.2m (1.1%) transfer from the Schools Block, a £0.2m transfer of early years funding, and a Council Contribution of £2.4m, as set out in paragraphs 33 to 53;
(e) that the Interim Chief Finance Officer provides the Shadow Authority with a schedule setting out the rate of council tax for each category of dwelling further to Members’ consideration of the decision required in respect of (a) above and after taking account of the precepts to be levied by the local Police and Fire Authorities, Neighbourhood, Town and Parish Councils once these have been determined prior to the Shadow Authority meeting on the 21 February 2019.

2019/20 Council Tax Resolution
The Interim Chief Financial Officer submitted a report, a copy of which had been circulated to each Member and a copy of which appears as Appendix ‘B’ to these Minutes in the Minute Book.
The report sought Members approval on the formal passing of a formal resolution to determine the Council Tax for the year commencing 1 April 2019.
Members were reminded that in accordance with The Local Authorities (Standing Orders) (England) (Amendment) Regulations 2014 a recorded vote must be taken on this item.
Councillor John Beesley moved and Councillor May Haines seconded that the Council tax resolution as set out below be adopted:
DECISION MADE that:-
1. It be noted that on 19 December 2018 the BCP Shadow Authority calculated the Council Tax Base2019/20:
a. For the BCP Council is split for the year 2019/20 as Bournemouth 63,723, Christchurch 20,494 and Poole 57,555 (Item T in the formula in section 31B of the Local Government Finance Act 1992, as amended (the “Act”);and
b. For dwellings in those parts of its area to which a Parish precept relates as in the attached AppendixC.
2. Calculate that the Council Tax requirement for the Council’s own purposes for 2019/20 (excluding parish, town and neighbourhood precepts) as£209,612,183.
3. That the following amounts be calculated for the year 2019/20 in accordance with Sections 31 to 36 of theAct:
a. £800,675,467 being the aggregate of the amounts which the Council estimates for the items set out in Section 31A(2) of the Act taking into account all precepts issued to it by ParishCouncils.
b. £590,518,000 being the aggregate of the amounts which the Council estimates for the items set out in Section 31A(3) of theAct.

being the amount by which the aggregate at 3(a) above exceeds the aggregate at 3(b) above, calculated by the Council in accordance with Section 31A(4) of the Act as its Council Tax requirement for the year. (Item R in the formula in Section 31B of the Act).

5. That the Council, in accordance with Sections 30 and 36 of the Local Government Finance Act 1992, hereby sets the aggregate amounts shown in the tables below as the amounts of Council Tax for 2019/20 for each part of its area and for each of the categories of dwellings.

6. BCP Council must determine whether its2019/20 counciltax is excessive byreference tothe referendum principles setby the Secretaryof State and approved bythe House of Commons on5 February 2019.The measure ofexcessiveness is the 'relevant basic amount ofcouncil tax’ (essentiallythe band Dfigure excludinglocal precepts). TheSecretary ofState may prescribe AlternativeNotional Amounts(ANA) of RBAto beused in respect of the precedingyear where there has been a change oflocal authority functions. The transferof functions in the Christchurch predecessor areato new townand neighbourhoodcouncils means that ANAs have been setfor BCP Council to use inrespect of2018/19.
Alternative Notional Amount as regards the financial year beginning 1 April 2018
(a) Christchurch predecessor area of new Bournemouth, Christchurch and Poole Council -£1,598.30
(b) Bournemouth, Christchurch and Poole Council -£1,445.61
As BCP Council is calculating different amounts of council tax under Part 4 of the 2008 Regulations, it may apply the referendum principle to either the increase in the average ANA-adjusted RBA across the predecessor areas or - as is recommended here - to the increase in the ANA-adjusted RBA in each individual predecessor area.
As such the authority’s relevant basic amount of council tax for 2019/20 is excessive if the amount mentioned in section 52ZC(3C)(a)(a) of the 1992 Act is 3%+A% (comprising A% for expenditure on adult social care and 3% for other expenditure), or more than 3%+A%, greater than the amount mentioned in section 52ZC(3C)(b) of that Act in one or more of its predecessor areas.
The value of the increase for Bournemouth is calculated as 2.40%, Christchurch as -0.55% and Poole as 2.99% and therefore the Council has determined that there is no excessive increase. For information the Bournemouth Holdenhurst area is 2.25%.

Constitution for BCP Council
Councillor Nicola Greene moved and Councillor May Haines seconded that the resolution as set out in the report be adopted.
An amended recommendation was proposed by Councillor Lesley Dedman, this was seconded by Councillor Margaret Phipps that:-
In relation to Article 8 other committees;
- Delete Planning Committee consisting of 15 Councillors and insert three area Planning Committees each consisting of nine members elected for wards wholy or partly in that area;
- One Area Planning Board shall have responsibility for the area of the former Borough of Bournemouth, one for the former Borough of Christchurch and one to cover the area of the former Borough of Poole;
- Each Committee shall determine applications under Part 3 Clause 3 for that area, and references in Part 3 Article 2 to Planning Committee shall be deemed to refer to the appropriate Area Planning Committee; and
- Delete in Part 3 Article 2, Paragraph 2.2(G) (IV) and insert new paragraph ‘any application to which a statutory consultee has objected’
Following debate the amendment was withdrawn as it was noted that there would be future opportunities to review the Committee structure and related elements of the Constitution.
DECISION MADE that the Constitution as appended to the report be approved.

BCP Local Transport Plan (LTP) Capital Programme for 2019/20
Councillor Mike Greene moved and Councillor Ian Potter seconded that the resolution as set out in the report be adopted.
DECISION MADE that:-
(a) the 2019/20 BCP Local Transport Plan Capital Programme as set in Appendix A be approved; and
(b) indicative 2020/21 and 2021/22 BCP Highways Maintenance Programmes as set out in Appendix B be approved.
